These Terms of Service ("Terms") govern your use of the Maark app and service. By creating an account or using Maark, you accept these Terms. If you do not accept them, do not use the service.

2. Purpose and acceptance
Maark is an app that lets you save, organize and share links, alone or with other people. These Terms set out the conditions under which you may use this service.
By using Maark, you confirm you have the legal capacity to enter into this agreement and accept these Terms in full, together with our Privacy Policy.
3. Account and guest mode
- Maark can be used in guest mode, without an account. Creating an account (via email, Google or Apple) lets you sync your data across devices and share with other people. Data created in guest mode is transferred to the account when you sign up.
- Guest mode is tied to your device: if you uninstall the app or switch devices without creating an account, guest data may be lost, and an inactive guest profile with no lists may be deleted after 30 days.
- You are responsible for keeping your account access confidential and for the activity carried out from it.
- You agree to provide accurate information and not to impersonate anyone.
4. Use of the service
You agree to use Maark in accordance with the law, these Terms and normal use of the service. In particular, you must not disrupt the operation of the service, circumvent its security measures, or access it by unauthorized automated means.
The service includes the mobile app, the maark.app website and the Maark browser extension (Chrome, Firefox), which lets you save the current page to your lists. These Terms apply to all of them. The service is offered free of charge. Maark may offer additional features or capacity as paid options; whatever is free when you use it is not taken away retroactively.
5. User content (UGC)
Maark lets you post content: links, list names, descriptions, places and categories, comments, reactions, display name, public handle and profile picture ("your Content"). You are solely responsible for your Content and for the consequences of posting or sharing it.
Each list has a visibility you choose: private (members only), public (viewable by anyone and featured in search and discovery) or accessible by link, known as “unlisted” (viewable by anyone with the link, but absent from search). On a public or link-accessible list, the links, comments, members, and the names of people who opened or reacted to a link are visible to every reader. Check a list's visibility before posting or reacting in it.
Sharing and invitations
- You can invite someone by handle only if they are one of your contacts (you already share a list, or you have already invited them), by email, or by creating an invitation link.
- An invitation link is an access grant: anyone who has it can join the list as an editor, until it expires (48 hours) or is revoked. Share it only with the people you want to admit. You remain responsible for the people you admit to your lists.
- Roles (editor, admin) determine what each member can do; an admin has the same rights as the owner on the list.
You confirm that you hold the necessary rights to the Content you post and warrant that it does not infringe any third-party rights.
6. Prohibited content and conduct
You agree not to post, share or distribute through Maark any content that is, in particular:
- illegal, or that promotes illegal activities;
- offensive, hateful, discriminatory, harassing, threatening or defamatory;
- pornographic, sexually explicit, or involving minors;
- violent, or inciting violence, terrorism or self-harm;
- infringing on the privacy or rights (including intellectual property) of others;
- misleading, fraudulent, or constituting spam;
- containing malware or links to such content.
You also agree not to harass, threaten or impersonate other users.
7. Moderation and reporting
Maark provides in-app tools to report content or a user and to block a user.
Moderation commitment. We commit to reviewing content reported as offensive or abusive and to taking appropriate action (including content removal and/or removing the author) within 24 hours of the report. No offensive content is tolerated.
We may also act on our own initiative if we become aware of content that breaches these Terms.
8. Content removal and account suspension
We reserve the right, at any time and without notice, to:
- remove, hide or restrict access to any Content that breaches these Terms or the law;
- suspend or delete a user's account in the event of a serious or repeated breach, or to protect other users, the service or third parties.
In the event of suspension or deletion for a breach, no refund or compensation is due.
9. Intellectual property
- Your Content belongs to you. You retain all rights to the Content you post.
- You grant us only the non-exclusive, limited license necessary to host, store, reproduce and display your Content for the sole purpose of providing the service (in particular, sharing it with the people you authorize and syncing it across your devices). This license ends when you delete your Content or your account, subject to technical purge and backup delays.
- The Maark app, its brand, logo and graphic elements are protected and remain the property of their owner. No rights to these elements are granted to you.
- Geographic data. The place directory (cities, regions, countries) offered to locate a list is built from GeoNames data (licensed under CC BY 4.0) and, for France, from Etalab's API Géo (Open Licence 2.0). This data is imported onto our servers; no request is sent to these services while you use the app.
10. Availability and warranties
The service is provided "as is" and "as available". We use our best efforts to keep it working properly, without guaranteeing continuous availability or the absence of errors. We may change, suspend or discontinue all or part of the service.
11. Liability
To the extent permitted by law, Maark cannot be held liable for indirect damages resulting from the use of, or inability to use, the service, nor for content posted by users or third-party sites that saved links point to. Nothing in these Terms excludes liability that cannot lawfully be excluded (in particular in the event of gross negligence or willful misconduct).
12. Termination
You can stop using Maark and delete your account at any time from the app (Settings → Account → Delete my account). Deletion erases the lists you own; contributions left in other people's lists (comments, reactions, history) are kept in anonymized form, as described in the Privacy Policy. We may terminate or suspend your access under the conditions set out in section 8.
13. Governing law and disputes
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the French courts will have jurisdiction. Consumers retain the benefit of the mandatory provisions of their country of residence.
