These Terms of Service ("Terms") govern your use of the Maark app and service. By creating an account or using Maark, you accept these Terms. If you do not accept them, do not use the service.

2. Purpose and acceptance

Maark is an app that lets you save, organize and share links, alone or with other people. These Terms set out the conditions under which you may use this service.

By using Maark, you confirm you have the legal capacity to enter into this agreement and accept these Terms in full, together with our Privacy Policy.

You agree to use Maark in accordance with the law, these Terms and normal use of the service. In particular, you must not disrupt the operation of the service, circumvent its security measures, or access it by unauthorized automated means.

The service includes the mobile app, the maark.app website and the Maark browser extension (Chrome, Firefox), which lets you save the current page to your lists. These Terms apply to all of them. The service is offered free of charge. Maark may offer additional features or capacity as paid options; whatever is free when you use it is not taken away retroactively.

5. User content (UGC)

Maark lets you post content: links, list names, descriptions, places and categories, comments, reactions, display name, public handle and profile picture ("your Content"). You are solely responsible for your Content and for the consequences of posting or sharing it.

Each list has a visibility you choose: private (members only), public (viewable by anyone and featured in search and discovery) or accessible by link, known as “unlisted” (viewable by anyone with the link, but absent from search). On a public or link-accessible list, the links, comments, members, and the names of people who opened or reacted to a link are visible to every reader. Check a list's visibility before posting or reacting in it.

Sharing and invitations

You confirm that you hold the necessary rights to the Content you post and warrant that it does not infringe any third-party rights.

You agree not to post, share or distribute through Maark any content that is, in particular:

7. Moderation and reporting

Maark provides in-app tools to report content or a user and to block a user.

Moderation commitment. We commit to reviewing content reported as offensive or abusive and to taking appropriate action (including content removal and/or removing the author) within 24 hours of the report. No offensive content is tolerated.

We may also act on our own initiative if we become aware of content that breaches these Terms.

10. Availability and warranties

The service is provided "as is" and "as available". We use our best efforts to keep it working properly, without guaranteeing continuous availability or the absence of errors. We may change, suspend or discontinue all or part of the service.

11. Liability

To the extent permitted by law, Maark cannot be held liable for indirect damages resulting from the use of, or inability to use, the service, nor for content posted by users or third-party sites that saved links point to. Nothing in these Terms excludes liability that cannot lawfully be excluded (in particular in the event of gross negligence or willful misconduct).

12. Termination

You can stop using Maark and delete your account at any time from the app (Settings → Account → Delete my account). Deletion erases the lists you own; contributions left in other people's lists (comments, reactions, history) are kept in anonymized form, as described in the Privacy Policy. We may terminate or suspend your access under the conditions set out in section 8.

13. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, the French courts will have jurisdiction. Consumers retain the benefit of the mandatory provisions of their country of residence.
